Cunningham Door & Window Online Payment Terms and Conditions

I agree to all of the following terms and conditions:

1. In consideration for being allowed to participate in this transaction, I release from liability and waive my right to sue Cunningham Door & Window, its employees, officers, volunteers and agents from any and all claims of credit card fraud and claims relating to the nonconsensual dissemination or receipt of private information, including claims of negligence, resulting in any physical injury, illness (including death) or economic loss I may suffer or which may result from my participation in this transaction or any events incidental to this transaction.

2. Any controversy or claim arising out of or relating to this transaction, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial (or other) Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
